1. Geltungsbereich und Vertragspartner
Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen von Speisen und Getränken, die telefonisch bei uns getätigt und anschließend vor Ort abgeholt werden.
Vertragspartner des Kunden ist:
Mit der Abgabe einer telefonischen Bestellung erklärt sich der Kunde mit diesen AGB einverstanden.
2. Bestellungen, Vertragsabschluss & Kein Online-Verkauf
Unsere Website dient lediglich der Präsentation unseres Angebots und der Bereitstellung unserer Kontaktdaten. Ein Online-Verkauf, ein digitaler Bestellprozess oder die Vermittlung über Lieferplattformen (wie z. B. Foodora, Lieferando etc.) findet nicht statt.
Der Vertrag kommt wie folgt zustande:
- Der Kunde gibt eine verbindliche Bestellung telefonisch über eine unserer Nummern auf.
- Die Annahme des Angebots und damit der Vertragsabschluss erfolgt mündlich durch unsere Bestätigung am Telefon, unter Vereinbarung eines ungefähren Abholzeitpunkts.
3. Preise und Zahlung
Es gelten die Preise zum Zeitpunkt der Bestellung, wie sie auf unserer aktuellen Speisekarte ausgewiesen sind.
Bruttopreise: Alle auf unseren Speisekarten, Werbematerialien und auf der Website angegebenen Preise sind Bruttopreise in Euro (€) und verstehen sich inklusive der jeweils gesetzlich gültigen österreichischen Umsatzsteuer.
Die Zahlung erfolgt bar oder mit den vor Ort angebotenen bargeldlosen Zahlungsmitteln (z.B. Bankomatkarte, Kreditkarte) direkt bei der Abholung der Speisen im Lokal.
4. Abholung und Abnahmeverpflichtung
Die bestellten Speisen werden frisch für Sie zubereitet. Die Speisen sind vom Kunden zum vereinbarten Abholzeitpunkt an unserer Betriebsadresse (Dr. Arthur Lemisch Platz 6, 9800 Spittal an der Drau) abzuholen.
Da es sich um schnell verderbliche Waren handelt, ist der Kunde verpflichtet, die telefonisch bestellten Speisen abzunehmen und zu bezahlen. Sollte der Kunde die Speisen nicht abholen, entbindet ihn dies nicht von seiner Zahlungsverpflichtung.
5. Kein Rücktrittsrecht (Widerrufsrecht)
Wir weisen darauf hin, dass für Verbraucher bei Fernabsatzgeschäften über schnell verderbliche Waren bzw. über Waren, die nach Kundenspezifikationen angefertigt werden, gemäß § 18 Abs. 1 Z 3 FAGG kein gesetzliches Rücktrittsrecht besteht.
Da unsere Speisen nach Ihrer telefonischen Bestellung individuell und frisch für Sie zubereitet werden und schnell verderblich sind, ist eine Stornierung oder ein Rücktritt nach erfolgtem Telefonat ausgeschlossen.
6. Gewährleistung
Es gelten die gesetzlichen Gewährleistungsbestimmungen. Der Kunde hat die Speisen bei der Übergabe auf Übereinstimmung mit seiner Bestellung und auf offensichtliche Mängel zu überprüfen.
Da es sich um Lebensmittel handelt, die für den sofortigen Verzehr bestimmt sind, müssen etwaige Reklamationen unverzüglich vor Ort oder telefonisch nach Entdeckung geltend gemacht werden.
7. Anwendbares Recht und Gerichtsstand
Es gilt ausschließlich österreichisches Recht unter Ausschluss des UN-Kaufrechts.
Für eventuelle Streitigkeiten aus diesem Vertrag ist das für 9800 Spittal an der Drau sachlich zuständige Gericht zuständig. Bei Verbrauchern gilt dieser Gerichtsstand nur, sofern sie ihren Wohnsitz, gewöhnlichen Aufenthalt oder Ort der Beschäftigung in diesem Gerichtssprengel haben.

These General Terms and Conditions (GTC) apply to all orders of food and beverages placed with us by telephone and subsequently collected on site.

2. Orders, Contract Conclusion & No Online Sales
Our website serves only as an informational platform. Orders cannot be placed electronically via the website. We do not offer delivery services via third-party platforms. Orders are placed exclusively by telephone.
The contract is concluded as follows:
- The customer places a binding order by telephone using one of our numbers.
- The acceptance of the offer and thus the conclusion of the contract is made verbally through our confirmation on the phone, with the agreement of an approximate collection time.
3. Prices and Payment
The prices at the time of the order, as stated on our current menu, shall apply.
Gross Prices: All prices indicated on our menus, promotional materials, and website are gross prices in Euro (€) and include the applicable statutory Austrian value-added tax.
Payment is made in cash or using the non-cash payment methods offered on site (e.g. debit card, credit card) directly upon collecting the food at the restaurant.
4. Collection and Obligation to Accept
The ordered dishes are freshly prepared. The dishes must be collected by the customer at the agreed collection time at our business address (Dr. Arthur Lemisch Platz 6, 9800 Spittal an der Drau).
Since these are rapidly perishable goods, the customer is obliged to accept and pay for the dishes ordered by telephone. Failure to collect the dishes does not release the customer from the obligation to pay.
5. No Right of Withdrawal
We point out that for consumers in distance selling contracts concerning rapidly perishable goods or goods prepared according to customer specifications, there is no statutory right of withdrawal in accordance with § 18 Paragraph 1 Z 3 FAGG.
Since our dishes are freshly and individually prepared for you after your telephone order and are rapidly perishable, cancellation or withdrawal after the telephone call is excluded.
6. Warranty
The statutory warranty regulations apply. The customer must check the food upon handover for compliance with the order and for obvious defects.
Since these are foods intended for immediate consumption, any complaints must be made immediately on site or by telephone upon discovery.
7. Applicable Law and Jurisdiction
Austrian law shall apply exclusively, to the exclusion of the UN Sales Convention.
For any disputes arising from this contract, the court with material jurisdiction for 9800 Spittal an der Drau shall have jurisdiction. For consumers, this place of jurisdiction only applies if they have their domicile, habitual residence, or place of employment in this judicial district.
